Der Bundesgesetzgeber versucht diese Herausforderungen mit der Sonderregelung § 248 BauGB Flaptekst The reconcilability of (inter)national climate protection goals with »Baukultur« (building culture) creates new tasks and challenges in urban development. The federal legislature tries to solve these challenges with the special regulation § 248 BauGB (Federal Building Code) as a deviation regulation in building laws. The objective of this work is to concretize the vague legal concept of building culture as well as cultural aspects in construction in the special regulation § 248 BauGB as terms of land rights as opposed to construction planning laws and cultural heritage protection laws of the German States. Of particular importance for the interpretation of the special regulation is the term »culture« in the legal sense as well as the laws of building design and cultural heritage. |
