- This work is a compilation of legal decisions from the Parlement of Toulouse, one of the most prestigious sovereign courts in early modern France. The Parlement of Toulouse was established in 1443 and served as the appellate court for much of southern France. It played a critical role in interpreting and applying both Roman and customary law. Gérard de Maynard was a judge at the Parlement of Toulouse. His juridical writings are distinguished by their analytical rigor and strong grounding in Roman law. Though not as widely known today as other jurists like Dumoulin or Cujas, Maynard represents a critical link in the evolution of French legal thought. Maynard’s decisions are structured as a series of 'questions' (quaestiones) that explore and resolve complex issues in civil law, drawing on Roman legal principles, customary law, and court precedents. Maynard provides a detailed examination of unusual or difficult legal questions encountered in the Toulouse court between the late 16th and early 17th centuries. These include matters related to property law, inheritance, contracts, obligations, procedural rules, and jurisdictional conflicts. Each case is analyzed with references to the Corpus Juris Civilis, glossators, commentators, and contemporary legal scholarship. The text is methodically arranged for legal practitioners and scholars, offering not only the decisions but the underlying reasoning, citations of authorities, and comparative notes. This latin edition was translated, edited and published with annotations by Hieronymus Bruckner. Bruckner’s work reflects the legal humanism of the early 17th century and his editorial additions contribute further clarity and scholarly framing to Maynard’s original work.
